I’m no longer posting the questions and proposed answers for the four past Sundays of the 2008 bar exams (Political Law, Labor Law, Civil Law, Taxation, Mercantile Law, Criminal Law, Remedial Law and Legal Ethics). Please refer to phBar.org for the questions and the discussions.
Incidentally, the subject matter covered by Question No. 6 in Criminal Law was discussed at the phBar.org prior to the bar exams. The question goes:
Hubert and Eunice were married in the Philippines. Hubert took
graduate studies in New York and met his former girlfriend Eula. They renewed their friendship and finally decided to get married. The first wife, Eunice, heard about the marriage and secured a copy of the marriage contract in New York. Eunice filed a case of bigamy against Hubert in the Philippines.
a) Will the case prosper? Explain. (4%)
b) If Eunice gave her consent to the second marriage, what will
your answer be? Explain.
The concesus is that there is no criminal liability based on the territoriality principle. This is also the opinion of a lawyer-friend when we discussed this topic during a MCLE lecture last month. On the other hand, I said that my first impression is this: there is criminal liability even if the second marriage was solemnized abroad. What do you think?

Oo, nga naman atty. fred, bakit until now wala kang reactions sa posts namin? When I went over sa 2008 Bar Ex forum, ang dami mong mga consoling reactions. Bakit sa amin wala po? Is this a good sign? Is it because the 2007 Bar Exam was tainted with impending controversies kaya marami kang intervening comments while this 2008 Bar Ex ay reasonable ang dating kaya poh lang silent kayo till now? Or was it ayaw ninyo sa mga bloggers ngayon? Hope the former reason is the reason why passive po kayo till now…; If that’s the case then so be it.
Pero po atty. fred, I insist, your words are very important to us… Mas mahalaga pa kay kang kuya Adan (PEACE, tito Adan)…
So plezzz naman poh atty. fred, say something.. We are still lost!

Let’s face it. Hindi lahat papasa. Alam nyo sa mga sarili nyo kung deserving kayong pumasa. Kung tingin nyo di pa, I suggest you better start reviewing your notes for this year’s exam or whatever Plan B you have. I may be harsh but that’s the plain truth.

I doubt its release tomorrow usually after the announcement by the Supreme Court Spokesperson the ever charming Atty. Midas Marquez a day after pa ang release. But I dont say its not possible, he may make an announcement and on the same day the result. Lets just pray, it shall never too late even at this point in time. I repeat in failing, we will pass as Jesus said when I am weak I am even at my strongest. God bless us all.
It’s 99.99% sure, release will be on April 3, with 38% passing rate… oath taking will be on May 08 the last friday of J. Tinga with the SC.
