I’m no longer posting the questions and proposed answers for the four past Sundays of the 2008 bar exams (Political Law, Labor Law, Civil Law, Taxation, Mercantile Law, Criminal Law, Remedial Law and Legal Ethics). Please refer to phBar.org for the questions and the discussions.
Incidentally, the subject matter covered by Question No. 6 in Criminal Law was discussed at the phBar.org prior to the bar exams. The question goes:
Hubert and Eunice were married in the Philippines. Hubert took
graduate studies in New York and met his former girlfriend Eula. They renewed their friendship and finally decided to get married. The first wife, Eunice, heard about the marriage and secured a copy of the marriage contract in New York. Eunice filed a case of bigamy against Hubert in the Philippines.
a) Will the case prosper? Explain. (4%)
b) If Eunice gave her consent to the second marriage, what will
your answer be? Explain.
The concesus is that there is no criminal liability based on the territoriality principle. This is also the opinion of a lawyer-friend when we discussed this topic during a MCLE lecture last month. On the other hand, I said that my first impression is this: there is criminal liability even if the second marriage was solemnized abroad. What do you think?

same query here, meron bang ganung fact, 11 to 20? kasi sabi sa akin, last year daw, di nagrank ng hanggang 20, hanggang 10 lang talaga. tulad ng year na ito.

Yes, there is such a thing as top 11-20. I’m not sure how you can find it but there’s a record of it with the SC.
Re: the case of Province of Cotobato vs. The Gov’t of the Rep. of the Philippines, I submit that even it is out of the bar coverage, there is still a possibility it might be included. It happened before with EO 464 (but it was expressly mentioned in the coverage). Lets just see if they will mention this case during the pre-week review.
@ Syphon_Filter…There is such a thing as a top 20 pero its useless kase you cannot prove it because the SC will not issue a certification to that effect that you are No. (____11-20___).
Ikaw na rin nagsabi.. expressly provided sa coverage…since this year hindi sinabi so hindi kasale.. don’t waste ur time reading stuff that is outside the coverage.. stick to the basics.. kung magbabasa ka ng outside the coverage di sana hindi na rin nagissue ang SC ng coverage diba?
don’t worry nandyan ang UP Law to watch out for these outside the coverage questions….ok?
