VIII.

Bobby, an incoming third year college student, was denied admission by his university, a premiere educational institution in Manila, after he failed in three (3) major subjects in his sophomore year. The denial of admission was based on the university’s rules and admission policies.

Unable to cope with the depression that his non-admission triggered, Bobby committed suicide. His family sued the school for damages, citing the school’s grossly unreasonable rules that resulted in the denial of admission. They argued that these rules violated Bobby’s human rights and the priority consideration that the Constitution gives to the education of the youth.

You are counsel for the university. Explain your arguments in support of the university’s case. (6%)

  1. Sa ibang examinees baka iniisip nila eh nagmamagaling tayo, academic discussion lang po ito feel free to join in. Ang pagpasa po nating lahat eh nakadepende sa appreciation ng examiner ng sagot natin. Good luck sa ating lahat 🙂

    1. Di naman siguro, parati namang may word of caution ang mga answers natin like hindi ako sure, eto ang nasagot ko etc., kung may sagot naman sila na mas better they could always punch the keys. Tsaka mas magandang pampalipas ng oras ito kesa kimkimin mo lang sa sarili mo ang anxiety of waiting for the results, lahat naman tayo regardless of our discussions here are hounded by the same uncertainties of this bar exam.

  2. as per BIR friend:

    minsan nakapanood daw sya ng lecture vid ni atty. maneja (topnotcher from UST with a 92%+ grade).

    sinabi ni atty. maneja that when the suggested answers for her bar exam questions were released, nagulat daw sya dahil ang layo daw ng ibang mga sagot nya.

    she then requested her professors to review her booklets and after which, her professors told her that it was not really giving the correct or absolute answers but instead it was the way on how she presented her answers in a logical and responsive way that was perhaps given proper credit by the examiners.

    if this is true, may factor din siguro ang writing technique at manner of presenting our answers sa pagbibigay ng credit ng mga examiner?

    1. Benj sana talaga tama ka, kasi may mga sagot ako na feeling ko lumalaban ako ng Essay Writing contest. Yung konti lang alam ko na legal basis at di ko pa sigurado, pero inilaban ko na lang sa style at sa confidence (kapal ng mukha). Yung di ko talaga alam kung tama sagot ko pero confident na confident ako with matching draft muna, margin, maayos na sulat at walang bura.

    Naisip ko while answering, pag ako kaya nagpakamatay dahil sa Bar pwede kaya idemanda ang Examiner (kasi di pwede ang SC because of State immunity) hahaha.

    1. Pong i don’t think na masue mo din examiner kasi he/she is acting as an agent of the SC so i think may state immunity pa din. Hahaha
