The law is perceived as something alien; a set of esoteric words that confuses the people who are supposed to be governed by it. This is unfortunate, primarily because ignorance of the law excuses no one. Moreover, the law permeates into ALL aspects of our lives – BEFORE until AFTER we die. Hence, it’s better to get to know that legal alien a little more.

I can’t leave my bf because I really love him. Besides, it was not his fault why his first marriage didn’t work out. His wife had an affair with another married man. Since then, they did not see each other again. It has been 10 years since that happened. I really want to get married with the one I really love. What can I do? We are planning to get married in my hometown without his annulment. But I know that marriage won’t be legal. I am scared to tell my whole family that my bf now is already married to another woman. They always ask us about the wedding. I feel guilty whenever they do that. They are really expecting that I would end up walking down the aisle in a wedding gown. My bf is so responsible. My relatives from both sides love him. We are thinking of pursuing the wedding just for them and keep the secret within the two of us while working on the annulment. Please give some pieces of advice. What can I do? Can he file the declaration of presumptive death of an absent spouse?

Good morning.
I would like to refer the case of my fellow OFW who is now working in Dubai , UAE. Last August 2006, he was already applying for an overseas job and eventually managed to borrow PHP 50,000. from a Trader in Dumaguete, Negros, Oriental. The money was used for the purchase of construction materials for the repair of their house. The agreed interest rate is 20% per month. However, my friend was not immediately deployed since he needed an immediate medical attention as there was a growth on the chest which needed to be operated on. He was operated and was advised to rest and in November 2009, he finally got deployed to Dubai, United Arab Emirates.
His problem now is from the time he borrowed the money until today, 30 December 2009, they have not made a partial payment for both the principal and interest. They were verbally advised that the cumulative arrears for both Principal and Interest has gone beyond PHP 100,000. as of end of December 2009. I would like to help my friend but my question is, is the agreement between the two parties imposing 20% interest per month legal and enforceable noting that in the abolition of the usury law, the acceptable rate of interest is 24% per annum and higher than that is unconscionable.
Would like to request you to confirm if what I understood is right and my friend can be obliged to pay only PHP 50,000. plus a maximum of 24% per annum. We are willing to pay even up to 36% if the lender agrees on such condition to liquidate and pay off the loan. Also we agree to pay full interest for a period of one year regardless if the 12 month period is completed. But 20% per annum is not reasonable at all.
Can they approach any colleague of yours in Dumaguete City for consultation? Since I do not know any lawyer in that area, I suggested to them the idea of seeking the help of PAO in Dumaguete City but Im not sure if the office exists . His family is bothered by almost daily visits by the Trader’s representative / collector.
By the way, does the case have any merit in favor of my friend? Or the Philippine law does not provide any protection for victims of unreasonable lending activities.
