The reference to Abe is only an illustration. However, the fact remains that in the PEP case, the public prosecutors found probable cause on the basis of a comment appearing on their blog. The absence of malice may be a defense, but given this precedent, it’s definitely a hassle to go through all the court proceedings.

The absence of malice on the part of Abe may render any libel action preposterous. The “malice” element may release Abe from any responsibility.
