In the previous post on the extension of the compliance period (to 1 January 2009) for Bar Matter 1922, Alpha_Mike and Orbil inquired about the rule applicable to new lawyers. This is covered by MCLE Governing Board Order No. 1, s. 2008, which pertinently provides:
“. . . lawyers who pass the Bar when only four (4) months or less remain of the compliance period, are exempted from complying with the MCLE requirement for the said compliance period. They shall comply with the MCLE requirements for the next compliance period.
However, lawyers who are admitted to the Bar either one (1) year after the start of the current compliance period, or two (2) years after the start of the said compliance period, are required to comply with the MCLE requirements in accordance with the MCLE Governing Board resolution dated October 20, 2004, i.e. those admitted one year after the start of the current compliance period must comply with two-thirds (2/3) if the credit units required (24 c.u.) for that period; while those admitted two (2) years after the start of the compliance period should comply with one-third (1/3) of the required credit unit (12 c.u.)
There are three questions that would immediately come to mind: (1) What is the current compliance period? The third compliance period is from April 2007 to April 2010; (2) When is a lawyer “admitted to the Bar”? A MCLE Board staff said it’s the signing of the roll of attorneys; and (3) What will I indicate in the pleading if I’m exempted because I “pass[ed] the Bar when only four months or less remain of the compliance period”? That same staff also mentioned that the new lawyer could indicate “Exempted, pursuant to MCLE Governing Board Order No. 1, s. 2008″. Perhaps someone could verify the answer to question No. 3.

thanks Atty. Fred, sir. that is a great relief… but, of course,
if i gain the time (and the cash) anytime soon, i’ll be joining in
the lectures alright, they could well serve as a cozy getaway from
the daily grind of lawyering…
@ Atty. Fred: Starting a career in the field of Law has been very hard for me in our province in Nueva Ecija. Most of the cases are Civil and Land-related… could have been a very good start (not to mention, it could be very profitable), but I was surrounded by friends, friends of my parents… and their friends’ friends, and relatives… All the cases that came my way were all free… as in ALL…. I even spend for the photocopies and all… I ended up having nothing, even just some money to refill the ink of my printer. So, I decided to come here in Metro Manila. Now I’m looking for work.
Sheesh…
Anyway, I’m an optimistic guy, so I am hopeful I will have a real job of my own soon. =)

As for me, pumasok ako as in-house counsel in one of the big construction firms here in Cebu. But after three months I decided to leave them because my practice was restriction on the affairs of the company, I’m prohibited to take other cases. So now, much as I closed a good retainership deal with an aviation support company, I’m now having my own office. Good thing my location is quite strategic ‘coz my office is infront of the city hall… Thus, for my operating expenses sa office, sagot na ng retainer fee ko. And for now, may mga cliente na din naman.

@alpha_mike: panyero how’s the practice? balita ko your trying for the solgen… how’s the exam? ano itsura offices? and what position are you eligible for? AS I or II? Thanks… i’m thinking of career change kasi to broaden my horizon…

i passed the 2007 bar, and mcle was sponsored by our agency, so i attended and completed it, nakaka-bored pala ang mcle! :p
