Warrant of Arrest issued Against former President Gloria Arroyo

A warrant of arrest has been issued against former President Gloria Macapagal-Arroyo in connection with the electoral sabotage filed against her and other respondents, including former COMELEC Chairman Benjamin Abalos.

This is non-bailable, so any talk of a watch list or Hold Departure Order (HDO) is moot at this point. All the accused cannot leave the country. If the Supreme Court is very busy with all the legal maneuverings of all parties concerned, it will become even busier in the days to come.

Some say the case was filed in haste. Some say the issuance of the warrant of arrest is only right. Some say it’s payback time. Everybody has an opinion. It’s going to be very, very interesting. What do you think?

  1. I think this one contradicts what has been done by the supreme court a couple of days ago. The supreme court issued a TRO and then suddenly a warrant of arrest wud be filed? This ain’t right in my own sentiment. There’s no need for scrutiny, She’s being deprived of liberty. I’m not trying to vindicate CGMA, If she really did something that makes her liable to law, then that’s it. I just find it inhumane that the DOJ Sec. Leila de Lima as an excellent lawyer herself rejected the TRO issued by the highest court in the land. GOSH!

If the evidences and testimonies were strong and sufficient, then she should’ve been behind bars the moment she stepped down from presidency as she lost her power and immunity in such. I wonder why this case is ending too late! This must have happened before if only the judicial department of the Gov’t did their business in just time!

    1. andrei, there’s no contradiction. The TRO relates to the issuance of the DOJ watch list. The warrant of arrest relates to the criminal case. Magkaiba. The logical effect of an arrest is the deprivation of liberty. Within the bounds of the law yan.

      Kung ano ang tinanim, yan din ang aanihin. Ang mahirap lang kse sa marami ang sinasagasaan pag-akyat, maraming matutuwa sa pagbagsak. Kawawa naman si CGMA, may sakit at under arrest, samantala ang iba sa paligid nya e malayang nakakagala.

  3. Kung sa debate pa, the House is divided. Some agree with the issuance of the warrant of arrest, others questions De Lima’s setting aside SC’s TRO. As for me, kung totoong may pananagutan si Arroyo, dapat lang maparusahan siya. Indeed, she’s entitled of the all the rights of the accused as provided in the Bill of Rights. Ang tapang ni De Lima, di ko kakayanin ang powers niya. If this case would be included in the bar exam next year, wow it wud be a very interesting item. Various opinions will be collated. Kalurki!

  4. midas, uhm isn’t it a contradiction?ipaparestrain then 2 days after eh ng issue na ng warrant of arrest? hindi ba deprivation of liberty ang watchlist order? what does it suppose to mean? what I am pointing out here eh wag samantalahin ang kalagayan ni cgma.look, why was the verdict not served even before cgma has her illness? bkit ngaun pa?to think na pwede nmn pla sana dati pa.

    1. Andrei, ang alam ko, di na pwede lumabas ng bansa pag may warrant of arrest. Pwede rin humingi ng hold departure order, o tawag HDO, pero ang korte lang ang pwede magbigay. E baket pa kse may watchlist, na ang Secretary of Justice lang ang pwede mag-issue? Korte na siya? Pero kahit ano pa man ang desisyon ng korte supreme dito, ang tanong ko lang e kaninong administrasyon ba ang nag-issue ng guidelines sa watchlist? Kay CGMA. Ang hirap sa mga policies na ginawa ng administrasyon nya, sya ang tinatamaan ngayon.

      Walang contradiction. Ang restraining order, sila ni CGMA ang nag-apply sa korte suprema. Ang warrant of arrest, ang RTC ang nag-issue. May kapangyarihan ang korte suprema na mag-issue ng TRO. May kapangyarihan ang RTC mag-issue ng warrant of arrest. Ang RTC ay kabilang ng judiciary. Walang kapangyarihan ang executive o presidente sa judiciary.

      Hindi naman basta-basta mag-file ng kaso, kaagad-agad. May imbestigasyon. Siguro ngayon lang nila natapos. Siguro minadali. Malalaman din natin sa mga darating na araw, kung tumakbo na ang kaso. Sundan natin ang susunod na kabanata.

    1. andrei, kaya nga pinagsabihan si namesake ko, si Spokesperson Midas Marquez, kse hindi naman accurate ang sinabi nya. Hindi naman pala immediately effective kse may mga tatlong conditions na binigay ang korte, at hindi lahat nasunod ng kampo ni CGMA. Isang Supreme Court justice yata ang nagsabi kay Midas Marquez.

      Kung “clear” na pwede talaga siya umalis, malalaman natin sa desisyon ng Korte Suprema sa petisyon ni CGMA. Dapat lang siguro linawin kung ang watchlist ba na issued ng DOJ e nagbabawal na sa paglabas ng mga tao sa bansa. Ang problema ni CGMA, ang administrasyon nya mismo ang nag-implementa nito, so may presumption ng validity. Ngayon at sya ang tinamaan nito, dapat lang siguro sya maghintay na maresolba.

      Isa pa, napapansin ko lang, ang ibang akusado derecho sa kalaboso. Kung gusto nila ma-ospital, sila ang magpakita ng pruweba sa korte na karapatdapat silang mapalabas sa kulungan at mapunta sa ospital. Eto yata ang dinanas ni Jason Ivler, yung anak ni Aguilar. Nakalabas na nga ang bituka, nasa bilangguan. Baket kay CGMA, baligtad — ang gobyerno ang kailangan maghanap ng pruweba na sa kulangan dapat sya at hindi sa ospital. Tsk. tsk tsk. Iba talaga ang batas para sa mayayaman at makapangyarihan.
